Artificial intelligence has moved far beyond pilots in finance. It now supports fraud detection, credit decisions, portfolio research, and compliance. The regulatory lens
In the United States, the SEC’s Division of Examinations listed artificial intelligence in its 2025 exam priorities for advisers and broker-dealers, signaling scrutiny of both model governance and how firms market AI capabilities. (SEC)
In Europe, the EU AI Act entered into force in August 2024. Creditworthiness assessment and similar finance use cases fall into the Act’s “high-risk” bucket, which triggers obligations for documentation, human oversight, testing, and governance. Global bodies are also sharpening their views. Core risk areas
Inaccuracy. Inaccurate outputs create legal and consumer-harm exposure, particularly in credit. U.S. lenders must give specific and accurate adverse-action reasons, even when decisions involve complex or AI-driven models. Reality check on model quality: even the leading foundation models still report substantial error rates on factuality and hallucination benchmarks. Explainability. U.S. law requires adverse-action notices that explain “why,” and the EU AI Act places transparency and documentation at the center of high-risk AI obligations. The SEC’s first “AI-washing” actions against Delphia and Global Predictions show that misrepresenting AI capabilities can violate the Marketing Rule and draw enforcement.
